The draft Regulation on Insolvency Administration reshapes in depth access to the profession, the appointment system and the remuneration model, with the aim of strengthening the professionalisation and efficiency of the insolvency system.
Manuela Serrano, partner in the Restructuring and Insolvency area at Toda & Nel-lo and President of ASPAC, has published in Diario LA LEY a comprehensive analysis of the Draft Royal Decree approving the Regulation on Insolvency Administration, a provision set to mark a milestone in the evolution of Spanish insolvency law.
In the article, the author systematically examines the new unitary statute of insolvency administration, which brings together in a single text the requirements for access to the profession, the appointment system, the civil liability regime and the new remuneration model. Among the most notable aspects are the introduction of the professional aptitude examination, the threefold classification of proceedings according to their complexity and the sequential allocation system, all designed to reinforce professionalisation, objectivity and transparency in appointments.
The article pays particular attention to the comprehensive reform of the fee scale, based on criteria of efficiency, duration and incentives, as well as to the transitional regime designed to ensure a balanced implementation of the new model.
