Toda vez que algunos clientes nos lo han solicitado, os remitimos estos BREVES CONSEJOS SOBRE CREACI\u00d3N Y USO DE MARCAS EN EL MERCADO<\/strong>.<\/p>\n

    \n
  1. Se recomienda que la marca a crear y utilizar sea fuerte, distintiva. Es decir, que sea distinta a cualquier marca anterior existente para ese tipo de productos o servicios.<\/li>\n
  2. Cuanto m\u00e1s original sea, m\u00e1s fuerte ser\u00e1. Y, al rev\u00e9s, cuanto m\u00e1s descriptiva sea, m\u00e1s d\u00e9bil ser\u00eda, y m\u00e1s conflictos podr\u00eda tener (p.e. \u201cCamisas Se\u00f1or\u201d para identificar ropa de hombre es una marca muy d\u00e9bil y problem\u00e1tica).<\/li>\n
  3. Es aconsejable realizar una b\u00fasqueda completa previa al registro de una marca para comprobar si el nombre o logos identificativos elegidos han sido inscritos antes por otro empresario y, en su caso, si lo est\u00e1 utilizando y c\u00f3mo.<\/li>\n
  4. Se aconseja inscribir ante el registro (espa\u00f1ol o europeo) la marca antes de empezar a utilizarla en el mercado.<\/li>\n
  5. El registro de la marca o nombre comercial no es obligatorio, pero el nacimiento del derecho exclusivo sobre los mismos nace del registro v\u00e1lidamente efectuado.<\/li>\n
  6. Una marca inscrita ante la Oficina Espa\u00f1ola (OEPM) solo tiene protecci\u00f3n en Espa\u00f1a, y una marca inscrita ante la Oficina Europea (EUIPO) est\u00e1 protegida en todo el mercado de la Uni\u00f3n Europa (28 Estados Miembros, 500 millones).<\/li>\n
  7. Las tasas de inscripci\u00f3n de una marca espa\u00f1ola son de 140 Euros (para una clase \u2013tipo- de productos o servicios) y las de una marca europea de 850 Euros, tambi\u00e9n para una clase.<\/li>\n
  8. Si no registra el nombre o logo que utiliza en el mercado para identificar sus productos o servicios, otro empresario lo podr\u00eda hacer, por lo que entonces dicho competidor tendr\u00eda el derecho de utilizar la marca (nombre o logo) en el mercado.<\/li>\n
  9. Una vez inscrita la marca debe utilizarse en el mercado de forma efectiva, y debe hacerse en relaci\u00f3n a los productos o servicios para los cuales ha sido registrada. De lo contrario, un tercero podr\u00eda solicitar la nulidad de la marca para aquellos productos o servicios para los que no se utilice la marca.<\/li>\n<\/ol>\n
